RACE SCREENING TERMS AND CONDITIONS - Red Bull Racing Experiences

These Terms and Conditions will apply to any Oracle Red Bull Racing Race Screening (“Screening”) tickets (each a “Ticket”) purchased on the Eventbrite platform to be held at Oracle Red Bull Racing’s (“we” or “us”) UK headquarters in Milton Keynes (the “Factory”). By purchasing a Ticket, you hereby agree to these Terms and Conditions, and you and any person on whose behalf you are purchasing a Ticket will be deemed to have accepted these Terms and Conditions.

1. YOUR RESPONSIBILITIES
1.1 You hereby agree:
1.1.1 not to carry out any activity whilst in the Factory which is damaging, dangerous, offensive, illegal or immoral;
1.1.2 to comply with any security arrangements, directions or notices displayed or given by officers, employees or agents of or persons authorised by Red Bull Racing Limited, including but not limited to notices, directions or other requirements relating to access and security, medical matters, evacuation procedures, health and safety and conduct at the Race Screening;
1.1.3 to abide by the Red Bull Racing safety & well-being policies in place on site; and
1.1.4 not to attempt to access any part of the Factory other than those areas which you have been specifically advised you may access.
1.2 You agree to indemnify us, our employees, agents and contractors against all loss, damage or claims arising out of or in connection with your breach of clause 1.1 above.

2. OUR RIGHTS AND OBLIGATIONS
2.1 Save as otherwise set out in these Terms and Conditions, no variation to these Terms and Conditions shall be binding unless agreed in writing by us.
2.2 We reserve the right to amend these Terms and Conditions from time to time and will notify you of any such changes.
2.3 We shall have the right to prevent access or remove you from the Factory if:
2.3.1 you act in a way which in the reasonable opinion of us (in our absolute discretion) is unacceptable or reasonably likely to cause damage or injury to either you or any other visitor or to any of our staff (including but not limited to drunken, harmful, offensive, threatening, disrespectful or violent behaviour);
2.3.2 you are directly or indirectly associated with any of our Formula One competitors;
2.3.3 we believe that your admission would be materially prejudicial to any other person’s enjoyment of the Screening experience; or
2.3.4 you are in breach of any of these Terms and Conditions,
without any liability to you by way of compensation (including but not limited to travel and accommodation), refund, re-admission or otherwise.
2.4 Due to our operational needs of participating in such a fast moving, competitive sport, we may be required to act on short notice (e.g. for manufacturing and / or health and safety reasons) and shall be entitled to:
2.4.1 change the contents of the Screening without notice to you where such changes are required for operational purposes; and
2.4.2 close parts of the Factory without notice to you without liability to you by way of compensation (including but not limited to travel and accommodation), refund, re-admission or otherwise. As such we cannot guarantee that all advertised elements to the Screening will be available.

3. TICKET LIMITATIONS
3.1 Any child under the age of 12 (twelve) years of age is not permitted to attend and partake in the Screening.
3.2 Any person under the age of 16 (sixteen) years must be accompanied and supervised by an adult Ticket holder at all times.
3.3 Tickets may not be resold or transferred without our express written permission and may not be used for any competition, prize draw, and consumer or trade promotion or similar. Any Ticket re-sold or transferred in such a manner will become void and the holder may be refused admission or ejected from the factory.
3.4 You acknowledge that the Screening does not include any travel or accommodation and such arrangements must be booked independently of the Ticket.
3.5 If a Ticket has been issued to a named individual, it may only be used by that individual.
3.6 It is your responsibility to check any booking or order confirmation and to notify us as soon as possible of any error contained therein. We shall have no liability to you in the event of any error made during a booking and shall not be obliged to refund or replace any Ticket which contains an error which derives from the relevant booking.
3.7 We reserve the right to cancel any Tickets in the event that you breach any of these Terms and Conditions, and shall not be obliged to provide you with a refund in such circumstances.

4. CANCELLATION
4.1 We reserve the right to cancel any Screening at any time. In such circumstances we shall endeavour to provide notice to you (if reasonably possible and contact details are available) of such cancellation and, subject to clause 6, you shall be entitled to accept either an alternate date to attend a of the same value or to receive a refund. No further compensation shall be payable by us including but not limited to in respect of travel or accommodation costs you may have incurred.
4.2 A cancellation charge of 100% of the Ticket fee shall apply for any cancellation by you.

5. COVID-19
5.1 Both parties acknowledge the ongoing COVID-19 crisis in the UK and accept their obligation to comply with any official guidance from UK Government. The parties agree to communicate without delay any issues they may have in performing their obligations hereunder. You acknowledge that COVID-19 or any other health related matter pertaining to a pandemic or epidemic may require us to take one or more of the following measures for the safety of our staff and the safety of guests attending the Race Screening to which this booking relates:
5.1.1 impose maximum guest numbers on any Screening;
5.1.2 impose specific requirements regarding personal protective equipment such as the wearing of face coverings; and
5.1.3 request all guests to abide by the Red Bull Racing safety & well-being policies in place from time to time when on site.
5.2 If we decide to close our venue to visitors or reduce the maximum guest numbers of any Screening below your minimum requirements, we may offer you an alternative date for the Screening but if that cannot be agreed the booking will be deemed cancelled and your payment will be returned in full.
5.3 If you are unable to attend because of infections or bona fide travel restrictions, then we will offer you a postponement of the Race Screening, or agree to cancel the booking and return your payment in full.
5.4 You shall be responsible for any and all charges that you may incur in connection with this clause 5 and any costs associated with the purchase of any personal protective equipment where required.

6. EVENTS OUTSIDE OUR CONTROL
Save as otherwise set out within these Terms and Conditions, in the event that we are unable to provide the Screening in relation to the Tickets purchased on Eventbrite we shall not be liable to provide any refund to you if such failure to provide is due to an event outside our control, such as, without being limited to, cancellation of the Grand Prix event to which the Screening relates, Acts of God, fires, floods, weather, epidemics, war, motor racing accidents, cancellation of an event by the relevant governing body or other cause(s) beyond our reasonable control, not reasonably foreseeable and not caused by our acts or omissions.

7. LIABILITY
7.1 You hereby agree to indemnify us against all costs, losses and liabilities incurred by us as a result of any damage to the Factory or any item contained in the Factory caused by you and / or any actions by you or any person for whom you have purchased a Ticket.
7.2 THE FACTORY IS DANGEROUS AND NOISY AND YOU AND ALL TICKET HOLDERS TO WHOM YOU HAVE PROVIDED TICKETS ACKNOWLEDGE THAT YOU MAY BE EXPOSED TO POSSIBLE RISK OF PHYSICAL HARM DUE TO THE NATURE OF THE SCREENING. WE ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGE HOWSOEVER CAUSED TO YOU AND/OR TICKET HOLDERS, TO THE MAXIMUM EXTENT PERMITTED BY LAW AND YOU ACKNOWLEDGE THAT ATTENDANCE AT THE SCREENING IS SOLELY AT YOUR OWN RISK.
7.3 WE WILL NOT BE LIABLE FOR ANY LOSS, INJURY OR DAMAGE, HOWSOEVER CAUSED, TO YOU AND/OR TICKET HOLDERS OR TO YOUR PROPERTY (“LOSS”) EXCEPT WHERE AND ONLY TO THE EXTENT THAT ANY SUCH LOSS IS CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES OR AUTHORISED AGENTS.
7.4 Nothing in these Terms and Conditions seeks to exclude or limit the liability of any party in respect of fraud or death or personal injury caused by its negligence or any other liability which cannot be excluded or limited at law.

8. OTHER IMPORTANT TERMS
8.1 By purchasing a Ticket on Eventbrite you will have deemed to have consented on your own behalf and on behalf of any other person for whom you have purchased a Ticket to the use by us (and any third party approved by us) for the purposes of or in connection with any publication, exhibition or broadcast (including any advertising or promotional literature, campaign or material) in any media worldwide, of any still or moving image taken during the Screening where such images includes any image of you and you have waived such personality rights to the extent necessary to permit such use.
8.2 Any personal data processed by Red Bull Racing Ltd will be processed in accordance with Red Bull Racing Ltd Privacy Notice which is available here.
8.3 No term of these Terms & Conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a third party.
8.4 In the event that any provision in these Terms and Conditions shall for any reason be held by any judicial determination to be invalid or unenforceable, portions hereof shall continue to be in full force and effect and the parties shall use their reasonable endeavours to negotiate a substitute provision for the provision of these Terms and Conditions held to be invalid or unenforceable as aforesaid to reflect the purpose or intent (as closely as may be possible) for such provision.
8.5 These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
8.6 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and each of the parties hereby agrees to submit to the exclusive jurisdiction of the English Courts as regards any claim or matter or dispute arising from or in connection with these Terms.

8.7 You acknowledge that in purchasing a Ticket you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms and Conditions or any document expressly referred to in them.

8.8 You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation based on any statement in these Terms and Conditions.
